TERMS AND CONDITIONS

York-Weaving Education Limited (“YWE”) is a private limited company with registered number 13758640 and registered office 85 Great Portland Street, London, England, W1W 7LT.

These terms and conditions set out the basis for all tutoring and other educational services provided by YWE.

1. Definitions


The following expressions are given the following meanings:

  • Student” means any person or their parent/guardian who engages YWE for the provision of tuition or other educational services.

  • Lesson Fee” is the fee payable by the Student to YWE as agreed between YWE and the Student. This may be at an hourly rate or a fixed fee depending on the service provided.

  • Third-party Tutor” means any person who is not an employee of YWE and is introduced to the Student by YWE for the provision of tutoring or other educational services, whereby YWE acts an agent to the arrangement.

  • Resources” means educational materials provided by YWE to the Student for the purposes of assisting with the provision of tuition services to the Student. This may include, but is not limited to, any documents, books or other materials.​
     

2. General


All business undertaken by YWE and the Student is transacted subject to these Terms. In the event of any conflict between these Terms and any other terms and conditions, these Terms shall prevail.

 

3. Cancellation policy and non-attendance


The Student may cancel a lesson without charge by informing YWE in writing at least 24 hours prior to the scheduled start time of a lesson.
 

For less than 24 hours’ notice the Student is obliged to pay the Lesson Fee in its entirety in respect of the scheduled lesson and YWE is not obliged to offer an alternative time for that lesson.
 

If a Student fails to attend a lesson within 20 minutes of the scheduled start time then that will be deemed non-attendance of the lesson and the Student will be liable to pay the Lesson Fee in its entirety.
 

YWE reserves the right to cancel a lesson at any time up to the scheduled start time of that lesson by informing the Student orally or in writing. In such cases the Student will not be charged the Lesson Fee. YWE will not be liable to compensate the Student for any such lessons cancelled by YWE.

 

4. Confidentiality

 

The Student must not share the Resources to any third party. The Student should not regard the Resources as their own or use the Resources for any purpose other than their own education.

 

5. Terms of payment

Unless otherwise agreed, YWE will generally invoice the Student in arrears on a monthly basis. If a Student does not pay the full amount of an invoice within 7 days, then the Student will incur a late payment fee of 10% of the total amount outstanding. If the invoice continues to be unsettled, then additional late payment fees of 10% will apply for every further 7 day period that the invoice is outstanding, until the full amount is settled. For example, an invoice that is overdue by 21 days would incur three late payment fees, amounting to 30% of the total amount outstanding from the overdue invoice.

Where educational services are provided by a Third-party Tutor introduced to the Student by YWE, YWE will invoice the Student directly for such services.

The Student must not make any payments directly to the Third-party Tutor.

The Student must not make any agreement with the Third-party Tutor which is intended to circumvent the relationship between YWE and the Third-party Tutor and to benefit the Third-party Tutor and/or the Student at YWE's expense.

6. Liability​

YWE makes no guarantee of grades, university placements or any other performance metric or outcome.

 

YWE shall not be liable in respect of any claim in any of the following circumstances:

  • Failure of the Student to achieve a given grade or grades in any test, exam or other situation.

  • Failure of the Student to be offered or to gain a place or places at a school, university or other institution.

  • Any other academic outcome which the Student finds unsatisfactory.
